Magmatic claimed that the Court of Appeal's ruling undermined the rights of more than 350,000 creative British businesses with designers left vulnerable to flagrant design infringement in the UK. The High Court judge did not give proper consideration and weight to the significance of the appearance of the Trunki as that of a ‘horned animal’.

The Court of Appeal had overturned the first instance decision, where the judge had found infringement, holding that the overall impression of the CRD was of a "horned animal".

The court must take into consideration the way that the particular design is intended to be used and interacted with, which may lead to certain design features having greater influence on the overall impression than others. Magmatic's appeal was therefore dismissed and the CoA's decision that there was no infringement was upheld. Firstly, the design’s validity is assessed – it must be new and have individual character when compared to any existing designs. The protection it gives extends to any design that does not produce a different overall impression on an informed user.

That it may be said is a matter of practice rather than law, and if further guidance is needed it can be sought from other sources, such as OHIM. This conclusion significantly limited the scope of the design registration and greatly contributed to the finding of non-infringement.However, Lord Neuberger's remarks suggest that such inattention to the visible features of a design representation is akin to filing a patent application without paying careful attention to each feature of the claims, or without recognising that claim integers really do limit one's protection. If the question of how to interpret the images on this design were to be referred, Lord Neuberger wryly predicted that the CJEU would answer that the drawings should be interpreted by reference to how they would appear to a reader in the light of the terms of the Principal Regulation, the Implementation Regulation and the practice of OHIM.
